Welcome to GoGrad Travel (“GoGrad Travel”, “we”, “us”, or “our”). GoGrad Travel operates this website and provides travel-related services, including trip coordination, lodging arrangements, transportation coordination, event logistics, and related offerings (collectively, the “Services”). GoGrad Travel is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (“Terms”), together with any policies referenced herein, describe your rights and responsibilities when accessing or using the Services.

Please read these Terms carefully, as they include important information about your legal rights, limitations of liability, disclaimers, and assumption of risk.

GoGrad Travel provides travel-related services, including coordination and facilitation of lodging, transportation, events, and experiences. We do not own, operate, or control airlines, transportation providers, lodging providers, venues, or other third-party service providers.

Descriptions of Services are provided for informational purposes only and are subject to change without notice. We do not guarantee availability, pricing, or outcomes of any particular service.

 

 

SECTION 3 – ORDERS AND BOOKINGS

When you place an order or booking request, you are making an offer to purchase Services. GoGrad Travel reserves the right to accept or decline any order at its sole discretion.

An order is not accepted until payment is processed and confirmation is issued. Once confirmed, changes or cancellations may not be possible and are governed exclusively by our Refund Policy.

All Services are offered for personal use only and may not be resold or redistributed without prior written consent.

 

 

SECTION 4 – PRICES AND BILLING

Prices are subject to change without notice and do not include applicable taxes, fees, gratuities, or third-party charges unless expressly stated.

You authorize GoGrad Travel to charge your payment method for all amounts due. You represent that you are authorized to use the payment method provided.

 

 

SECTION 5 – TRAVEL, TRANSPORTATION, AND LODGING DISCLAIMERS

GoGrad Travel acts solely as a coordinator and facilitator of travel-related Services. All transportation, lodging, activities, and experiences are provided by independent third parties. GoGrad Travel reserves the right to substitute any vendor, supplier, or service partner (including but not limited to hotels, transportation providers, and activity operators) with an alternative of equal or greater quality and value, at any time and without prior notice, due to availability, operational necessity, or circumstances beyond our control. In the event of any such substitution, GoGrad Travel will make reasonable efforts to notify affected travelers and ensure that the overall experience and value of the package is maintained.

We are not responsible for:

  • Acts or omissions of third-party providers

  • Delays, cancellations, overbooking, or service failures

  • Accidents, injuries, illness, property damage, or loss

  • Changes due to weather, mechanical issues, labor disputes, or government action

Any issues related to third-party services must be resolved directly with the applicable provider.

 

 

SECTION 6 – ASSUMPTION OF RISK

Travel involves inherent risks, including but not limited to personal injury, illness, property loss, delays, and unexpected changes. By using the Services, you knowingly and voluntarily assume all risks associated with travel and participation in related activities.

 

 

SECTION 7 – FORCE MAJEURE

GoGrad Travel shall not be liable for failure or delay in performance due to events beyond our reasonable control, including but not limited to acts of God, weather events, pandemics, government actions, strikes, civil unrest, transportation shutdowns, or supplier failures.

 

 

SECTION 8 – INTELLECTUAL PROPERTY

All content, branding, text, graphics, and materials on the Services are owned by GoGrad Travel or its licensors and are protected by applicable intellectual property laws.

You may use the Services for personal, non-commercial purposes only. Unauthorized use is strictly prohibited.

 

 

SECTION 9 – OPTIONAL TOOLS AND THIRD-PARTY LINKS

We may provide access to third-party tools or links. These are provided “as is” without warranties. GoGrad Travel is not responsible for third-party content, tools, or services.

 

 

SECTION 10 – RELATIONSHIP WITH SHOPIFY

The Services are powered by Shopify; however, all transactions are solely between you and GoGrad Travel. Shopify bears no responsibility for Services provided by GoGrad Travel, and you expressly release Shopify from all related claims.

 

 

SECTION 11 – PRIVACY

Use of the Services is subject to our Privacy Policy and Shopify’s Privacy Policy. By using the Services, you consent to the collection and processing of personal information as described therein.

 

 

SECTION 12 – FEEDBACK

You grant GoGrad Travel a perpetual, worldwide, royalty-free license to use any feedback you submit, without compensation.

 

 

SECTION 13 – PROHIBITED USES

You may not use the Services for unlawful, abusive, fraudulent, or harmful purposes, including scraping, impersonation, harassment, or interference with site security.

 

 

SECTION 14 – TERMINATION

We may suspend or terminate access to the Services at any time without notice. Obligations and disclaimers that by nature should survive termination shall survive.

SECTION 16 – LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOGrad Travel SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICES, INCLUDING TRAVEL-RELATED INJURIES, LOSSES, OR DELAYS.

 

 

SECTION 17 – INDEMNIFICATION

You agree to indemnify and hold harmless GoGrad Travel and Shopify from any claims arising from your use of the Services or violation of these Terms.

 

 

SECTION 18 – SEVERABILITY

If any provision is found unenforceable, the remainder shall remain in effect.

 

 

SECTION 19 – ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and GoGrad Travel.

 

 

SECTION 20 – ASSIGNMENT

You may not assign these Terms without consent. We may assign freely.

 

 

SECTION 21 – GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Indiana, without regard to conflict-of-law principles. You consent to exclusive jurisdiction and venue in Indiana courts.

 

 

SECTION 22 – CHANGES TO TERMS

We may update these Terms at any time. Continued use of the Services constitutes acceptance.
